Clear scope. Controlled access. Agreed work.
These terms describe the standard Branch & Button engagement. Your written scope controls if it states something different.
Effective September 16, 2026Written scope first
No paid engagement begins until the merchant receives and accepts a written scope identifying the pages or buying question covered, deliverables, exclusions, fee, timing, dependencies, measurement approach, and required access. Submitting a store or question does not create a purchase or service commitment.
Merchant responsibilities
You must provide accurate, authorized product facts and timely feedback; identify legal, regulatory, brand, and platform requirements that apply to your store; and ensure you have the right to share submitted information. Delays or incomplete information may change timing or require a revised scope.
Store access and changes
Store access must use an authorized account or connection with the minimum permissions reasonably needed. Approved work is prepared in a duplicate, unpublished theme when the platform permits. You review the work before release. We will not intentionally publish an agreed storefront change without the approval required by the written scope.
Fees and outside costs
The written scope states the service fee and payment schedule before payment. Platform subscriptions, paid apps, stock assets, development outside the scope, taxes, and other third-party costs are excluded unless specifically listed.
Measurement and reporting
We distinguish observed facts, interpretation, and open questions. We do not guarantee a lift or claim causation that the available evidence cannot support. If traffic, tracking, or assignment is insufficient for a controlled test, the report will state that limitation and describe what can still be evaluated.
Confidentiality
Each party will use the other party’s nonpublic business information only for the engagement and will take reasonable steps to protect it. This does not cover information that is public through no breach, already lawfully known, independently developed, or lawfully received from another source.
Ownership
After full payment, you own the final, store-specific deliverables identified in the written scope, excluding Branch & Button’s pre-existing methods, reusable tools, templates, know-how, and third-party materials. We retain ownership of those underlying materials and grant the rights needed to use the delivered work in your store.
Approvals and merchant decisions
You are responsible for approving factual claims, policies, pricing, product information, legal compliance, and release decisions. We may pause work that lacks required evidence or appears misleading, unsafe, unauthorized, or outside the agreed scope.
Ending an engagement
Either party may end an engagement as described in the written scope and the Cancellation & Refund Policy. Sections concerning payment, confidentiality, ownership, disclaimers, and limits of liability survive where necessary.
Disclaimers and liability
Services are provided with reasonable professional care, but business outcomes are not guaranteed. To the extent permitted by law, total liability arising from an engagement will not exceed the fees paid for that engagement, and neither party will be liable for indirect, incidental, special, consequential, or punitive damages. These limits do not apply where the law does not permit them.
